NEC4 NOTICE MECHANICS

The Windows That Matter

NEC4 ECC is a notice-heavy contract. Missing a notice window doesn't just weaken the position — it kills the entitlement entirely. The Clock tracks four critical windows simultaneously for every compensation event:

CLAUSE 61.3

CE Notification Window

8 weeks from Contractor becoming aware. Miss it → time-barred. The most dangerous deadline in NEC4.

CLAUSE 61.4

PM Response Window

1 week for PM to respond to CE notification. If PM doesn't respond → Contractor can escalate.

CLAUSE 62.3

Quotation Submission Window

3 weeks from PM instruction to quote (or as agreed). The Contractor's clock — quotation must be submitted on time.

CLAUSE 62.6

Deemed Acceptance Trigger

2 weeks for PM to respond to quotation. If PM doesn't respond → quotation is deemed accepted. Powerful lever.

NEAR-MISS — CE-007

3 Days From Time-Bar

Not every CE moves smoothly. CE-007 — late issue of revised ventilation design — was detected on 18 February but the formal CE notification wasn't issued until 11 April. Here's what happened and why The Clock exists.

⚠ CE-007 — Near-Miss Analysis

The ventilation design revision was received 18 February. The site team recognised the delay but initially treated it as a programme issue, not a compensation event. The commercial team was not notified until a routine weekly review on 8 April — 7 weeks and 1 day after awareness.

The 8-week time-bar (clause 61.3) would have expired on 15 April 2026. The CE notification was issued on 11 April — with 3 working days to spare. If the weekly review had been one week later, £18,400 of entitlement would have been permanently lost.

Outcome: CE-007 was notified in time. The PM did not dispute the notification. Quotation submitted 6 May, agreed 19 May at £18,400. But the process was tightened — site team now briefed to flag any employer-caused delay to the commercial team within 48 hours, not at the next weekly review.
